These SMS Terms of Service (“Terms”) govern the SMS/text messaging program (“SMS Program”) provided by Feldman Auto Sales and Feldman Auto Center (“Company,” “we,” “our,” or “us”). By opting into our SMS Program, you agree to these Terms.

 

1. Program Description

By submitting your mobile phone number, you authorize Feldman Auto Center and/or Feldman Auto Sales to send recurring automated marketing and informational text messages to the number provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply.

2. Opt-In Consent

5. Opt-Out Instructions

To stop receiving text messages, reply:

  • UNSUBSCRIBE 
  • QUIT

After you send an opt-out request, we may send one final confirmation message confirming your unsubscribe status. After this, you will no longer receive SMS messages from us unless you opt in again. Requests to opt out may take a reasonable period of time to process. During this period, you may receive limited communications necessary to complete processing of your request.

Opting out of marketing messages does not prevent us from sending transactional or legally required communications related to active service appointments, contracts, purchases, safety recalls, or ongoing business transactions where permitted by law.

SMS Data Protection

10. Disclaimer of Warranties

The SMS Program is provided on an “as-is” and “as-available” basis without warranties of any kind, express or implied.

We do not guarantee:

  • Uninterrupted service;
  • Timely delivery;
  • Error-free operation;
  • Complete message security.

Delivery may be affected by:

  • Carrier issues
  • Signal availability
  • Network outages
  • Device compatibility
  • Government actions
  • Technical interruptions

 

11. Limitation of Liability

To the maximum extent permitted by law, Feldman Auto Sales and Feldman Auto Center shall not be liable for:

  • Delayed or undelivered messages;
  • Message errors;
  • Service interruptions;
  • Data loss;
  • Unauthorized access;
  • Any indirect, incidental, special, or consequential damages arising from participation in the SMS Program.

 

12. Modifications to Terms

We reserve the right to modify or terminate the SMS Program or these Terms at any time without prior notice.

Updated Terms will be posted on our websites with a revised effective date. Continued participation in the SMS Program constitutes acceptance of any updated Terms.

 

13. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Indiana, without regard to conflict of law principles.

Any disputes arising from these Terms or the SMS Program shall be resolved in the appropriate courts located in Indiana.

 

14. Sweepstakes and Promotional Programs

 Sweepstakes, Giveaways, and Promotional Programs

Feldman Auto Center and Feldman Auto Sales may periodically offer sweepstakes, giveaways, prize drawings, promotional entries, loyalty rewards, or similar marketing programs. Participation in such promotions is subject to any applicable official rules.

No purchase is necessary to participate unless expressly stated in the official rules of a specific promotion.

Participation in promotional SMS campaigns does not increase the odds of winning unless specifically disclosed in the official rules.
